By accessing ReputationChamp.com or ReputationChamp.me (the “Sites”), you are agreeing to be bound by these web site Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trademark law.
Reputation Champ reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Sites following the posting of changes will mean that you accept and agree to the changes.
Content
All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such Content, contained on the Sites are owned, controlled or licensed by or to Reputation Champ, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws.
Except as expressly provided in these Terms of Use, no part of the Sites and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, without Apple’s express prior written consent.
Use License
You may not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Sites or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Sites or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Sites. Reputation Champ reserves the right to bar any such activity.
You may not attempt to gain unauthorized access to any portion or feature of the Sites, or any other systems or networks connected to the Sites or to any Reputation Champ server, or to any of the services offered on or through the Sites, by hacking, password “mining” or any other illegitimate means.
You may not probe, scan or test the vulnerability of the Sites or any network connected to the Sites, nor breach the security or authentication measures on the Sites or any network connected to the Sites. You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the Sites, or any other customer of Apple, including any Reputation Champ account not owned by you, to its source, or exploit the Sites or any service or information made available or offered by or through the Sites, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Sites.
You may not use the Sites or any Content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of Reputation Champ or others.
Disclaimer
The materials on Reputation Champ’s web site are provided “as is”. Reputation Champ makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Reputation Champ does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.
Reputation Champ reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Sites, or any portion of the Sites, for any reason; (2) to modify or change the Sites, or any portion of the Sites, and any applicable policies or terms; and (3) to interrupt the operation of the Sites, or any portion of the Sites, as necessary to perform routine or non-routine maintenance, error correction, or other changes.
Limitations
In no event shall Reputation Champ or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Reputation Champ’s Internet site, even if Reputation Champ or a Reputation Champ authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Fees
The Service accepts credit cards and PayPal. Reputation Champ may obtain preapproval for an amount up to the amount of the transaction. Fees are billed monthly, in advance of provision of the service. Billing occurs at the time of or shortly after your transaction. You agree that you will pay for the upgrades you purchase through the Sites, and that Reputation Champ may charge your credit card or payment account for any upgrades purchased and for any additional amounts (including any taxes and late fees, as applicable) that may be accrued by or in connection with your Account, and that Reputation Champ may continue to charge your credit card or payment account for all fees or charges associated with your subscription on an monthly basis until you change or cancel the subscription. This means that unless you change or cancel your subscription prior to the next billing date, we will charge your credit card or payment account the then-current fees on that next annual billing date.
All fees and charges paid by you in relation to the Service are nonrefundable, except as required by law or as otherwise stated herein. You can cancel your subscription through your PayPal account. If payment was processed by PayPal but not through your PayPal account, you can cancel by emailing admin@reputationchamp.com 3 days before your next billing date with your instruction to do so. Reputation Champ may at any time, upon notice required by applicable law, change the price of the services offered by the Sites. Price changes implemented during your subscription period will apply to subsequent billing periods and to all new subscribers after the effective date of the change.
Limitation of Liability
You expressly understand and agree that Reputation Champ and its affiliates, subsidiaries, officers, directors, employees, employee agents, partners and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, cost of procurement of substitute goods or services, or other intangible losses (even if Reputation Champ has been advised of the possibility of such damages), resulting from: (I) The use or inability to use the Sites (II) Any changes made to the Sites or any temporary or permanent cessation of the Sites or any part thereof; (III) The unauthorized access to or alteration of you transmission of data (IV) The deletion of, corruption of, or failure to store and/or send or receive transmissions or data on or through our Sites (V) Statements or conduct or any third party on the Sites; and (VI) Any other material relating to the service
Revisions and Errata
The materials appearing on Reputation Champ’s web sites could include technical, typographical, or photographic errors. Reputation Champ does not warrant that any of the materials on its web site are accurate, complete, or current. Reputation Champ reserves the right at any time to modify this Agreement and to impose new or additional terms or conditions on your use of the Sites. Your continued use of the Sites will be deemed acceptance of such modifications and additional terms and conditions.
